Seraphis Solutions Pty Ltd – Terms of Service
1. Acceptance of Terms: By purchasing or using Seraphis Solutions’ game server hosting services, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services. You must have legal capacity to agree (e.g. at least 13 years of age or older). Seraphis Solutions Pty Ltd (ABN: 44 688 762 085) may update or change these Terms at any time without notice. Continued use of our services indicates your acceptance of any revisions.
2. Service Description: Seraphis Solutions provides setup and hosting of game servers (e.g. Minecraft, Valheim, ARK, Rust, etc.). We install and configure the server software so you (the customer) can administer and play on the server. Seraphis Solutions is not affiliated with any game publisher or software; all game software and content are third-party products. Use of any game or third-party software is at your own risk and subject to their separate license terms. Once set up, you are the server administrator: you control all settings, mods, maps, and player access. You must have the necessary rights to any mods or content you install (for example, permission to use custom maps or plugins). Seraphis Solutions provides no warranty regarding game performance or compatibility, and does not support or fix game-specific issues beyond initial installation. You are responsible for maintaining and backing up your own data; Seraphis Solutions does not keep backups of your server files.
3. User Responsibilities: As the server administrator, you agree to:
- Maintain your account and server security. Keep your account credentials safe and notify us of any unauthorized use. You are responsible for all activities under your account and on your server (both yours and those of any players you invite).
- Follow all laws and rights. You may not use the service for any unlawful purpose or to violate any applicable law or regulation. This includes intellectual property laws (e.g. no illegal file sharing of copyrighted music, games, software, or media). You also agree not to host or distribute any defamatory, harassing, threatening, hate-based, pornographic, or other objectionable content. Harassing, bullying, or targeting individuals or protected groups is prohibited.
- No abusive or disruptive use. Do not use the service to transmit viruses, malware, spyware, or any malicious code. You must not engage in cheating, hacking, or any attempt to exploit or reverse-engineer our systems or networks. Spamming or sending unsolicited bulk messages via your server (including email or game chat spam) is prohibited. The server is not to be used for unrelated file hosting, cryptocurrency mining, DDoS attacks, or other resource abuse.
- Non-transfer and non-commercial use. The service is for your personal or community gaming use only. You may not resell, lease, assign or sublicense the service to another party without Seraphis’s express permission. Commercial use (charging others, running tournaments for profit, etc.) is not allowed unless explicitly agreed. If you open your server to additional players, you remain responsible for all social/community management; Seraphis Solutions will not moderate your community or take responsibility for player interactions.
Violation of any of the above may result in immediate suspension or termination of service without refund. Seraphis Solutions reserves the right to cooperate with legal authorities if an investigation arises.
4. Payments and Renewals: You agree to pay all fees for the service as billed. Fees are charged in advance (typically monthly) and are non‑refundable, except as expressly required by law. Seraphis Solutions does not offer partial refunds for downtime or configuration issues; all fees paid are generally final. As in industry practice, once your server is provisioned the period’s fee is not refundable. At Seraphis’s sole discretion, a refund or account credit may be issued in very limited circumstances (for example, if a critical hardware failure made the server unusable). You are responsible for canceling the service if you no longer need it; if your account is canceled mid‑period, no refund is owed unless otherwise required by law.
5. Service Availability (No Guarantee): You acknowledge that Seraphis Solutions provides hosting on a best-effort basis with no uptime guarantee or SLA. We will strive to keep servers online, but outages may occur due to maintenance, network issues, or other factors. Planned maintenance will be announced when possible. In all cases, you agree that occasional downtime is possible and that Seraphis Solutions is not liable for any losses or damages resulting from service interruptions. You have no claim for breach of contract or refund due to downtime or outages, except as required by law. You are strongly encouraged to maintain your own backups of any important data, since Seraphis Solutions does not back up your game server.
6. Limitation of Liability: To the fullest extent permitted by law, Seraphis Solutions and its owners, officers, and agents will not be liable for any indirect, incidental, special or consequential damages arising from your use of the service. This includes, without limitation, any loss of data, lost profits, business interruption, or personal injury. We disclaim all warranties — express or implied — including merchantability or fitness for a particular purpose. Seraphis Solutions makes no guarantee that the service will meet your requirements, or that it will be uninterrupted, secure, or error-free. Your sole remedy for any dispute or claim against Seraphis Solutions is to discontinue use of the service. Our total liability for any claim is limited to the amount you paid us in the six months prior to the claim.
7. Indemnification: You agree to defend, indemnify and hold harmless Seraphis Solutions (and its affiliates, employees and agents) from any and all claims, liabilities, losses, and expenses (including legal fees) arising out of or related to: (a) your use or misuse of the service; (b) your violation of these Terms; (c) any content or code you host; or (d) your infringement of any third party’s rights. In other words, any damage caused by what happens on your server is your responsibility. Seraphis Solutions is not obligated to defend or pay on your behalf under any circumstance.
8. Termination: Seraphis Solutions may suspend or terminate your account and service at any time, with or without notice, for any reason (including breach of these Terms). If your service is terminated, Seraphis Solutions will disable access to your server. You are solely responsible for retrieving your data and migrating it elsewhere before termination. Seraphis Solutions shall not be liable to you or any third party for any loss or damages arising from the termination of your service. After termination, Seraphis Solutions may retain copies of your server files for a limited time, but has no obligation to do so.
9. Changes to Terms: Seraphis Solutions reserves the right to revise or update these Terms at any time. When we do so, the new terms will be posted on our website and will take effect immediately. It is your responsibility to review the Terms periodically. Continued use of the service after changes signifies your acceptance. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force.
10. Governing Law: These Terms are governed by the laws of Australia. Any dispute arising under these Terms shall be resolved in the appropriate courts of Australia.
11. Contact and Support: Our technical support is limited to issues directly related to game server setup and hosting. We do not provide support for game-specific gameplay or for third-party software beyond what is explicitly stated. Support is provided on a best-effort basis during normal business hours. We make no guarantee of response time or issue resolution.
By using Seraphis Solutions’ services, you acknowledge that you have read, understood, and agree to these Terms of Service.
